Terms and Conditions

1. Membership in the Locals VIP Club (“Club”) is open to all residents of the United States, who are 21 years of age or older. Margaritaville employees are ineligible for membership.

2. To enroll, you must provide the information as requested on the Club application. By enrolling, you agree to the terms and conditions described herein.

3. The Club card must be presented at time of order to obtain benefits and redeem offers.

4. Only the Club cardholder that pays the bill may obtain benefits and redeem offers.

5. Margaritaville may cancel, modify, restrict or terminate the Club and these Terms and Conditions at any time for any reason without prior notification in its sole discretion.

6. In case of suspected fraud, misrepresentation, abuse, or violation of these Terms and Conditions, Margaritaville reserves the right to take appropriate administrative or legal action, including the termination of your Club membership.

7. By entering your e-mail address on the Club application, you agree to receive marketing e-mails from Margaritaville. You may opt out of receiving marketing emails by following the unsubscribe instructions included in such emails.

9. The Club card cannot be sold or transferred and the Card has no cash value. Void where prohibited or restricted by law or regulation.

10. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of any Club member or Margaritaville, shall be governed by, and construed in accordance with the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions. The Florida courts (state and federal) shall have sole jurisdiction of any and all controversies arising out of or related to membership in the Club and these Terms and Conditions. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Terms and Conditions shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
